FDA to Extend its Authority on Tobacco Products: Take Action Today

FDA has just issued a proposed rule – commonly referred to as “deeming” – that would extend the agency’s tobacco product authorities to cover additional products that meet the statutory definition of a tobacco product. Proposed deemed products include electronic cigarettes, cigars, pipe tobacco, certain dissolvables that are not “smokeless tobacco,” nicotine gels, and waterpipe (hookah) tobacco.

 

This is a historic action and one in which we encourage public participation. We wanted to share with you options for how to participate in the rulemaking process. Below we’ve included links to resources and sample content for spreading the word.

 

How can you get involved?

    Visit FDA’s new deeming webpage, Extending Authorities to Additional Tobacco Products, for information on our recent action. From this page, you can read the proposed rule, download resources, and find out how to comment.
  • Submit Your Comments 
    Your voice matters! FDA is requesting comment on the proposed rule. Public comments can be submitted online starting tomorrow. The proposed rule will be available for public comment for 75 days at Regulations.gov.
  • Spread the Word

FDA to Extend its Authority on Tobacco Products: Submit Your Public Comment Today

The FDA wants to hear from you and will be accepting public comment on a proposed rule that would extend its authority to regulate additional products meeting the statutory definition of a tobacco product. Tobacco products meeting the definition, or “deemed,” would include electronic cigarettes, cigars, pipe tobacco, certain dissolvables that are not “smokeless tobacco,” nicotine gels, and waterpipe (hookah) tobacco.

 

Your comments on the proposed deeming rule can be submitted online for 75 days starting Friday, April 25. Visit the FDA’s deeming webpage, Extending Authorities to Additional Tobacco Products, for information on all aspects of the proposed rule, and how your voice can make a difference.
